Terms of Service

1. Acceptance of Terms

By creating an account or using Today's Spark ("the app," "we," "us," or "our"), you agree to these Terms of Service. If you do not agree, please do not use the app.

2. User Accounts

You are responsible for the accuracy of the information you provide and for maintaining the security of your account credentials, including your password, authentication methods, verification codes, and linked sign-in providers (such as Google, Apple, email and password, or phone number). You must be at least 13 years old to use Today's Spark. You are responsible for activity that occurs under your account.

3. Acceptable Use

You agree not to misuse the app, including but not limited to: attempting to access other users' accounts or data, disrupting the service, uploading harmful or unlawful content, or using the app to harass or harm others.

4. Intellectual Property

The Today's Spark name, brand, letters, artwork, and app content are owned by FLAME OF LIGHT, LLC and its licensors and are protected by intellectual-property laws. You may not copy, redistribute, or create derivative works without permission, except as expressly allowed within the app (for example, sharing a letter through built-in sharing features).

5. User-Generated Reflections

Reflections, notes, and other content you create in Today's Spark remain yours. By saving them in the app you grant us a limited license to store and display them back to you as part of providing the service. Your reflections are private by default and are not shared unless you choose to share them.

6. Not Medical or Crisis Support

Today's Spark offers encouragement, reflection, and personal wellness content. It is not a medical, psychological, therapeutic, or crisis-intervention service and is not a substitute for professional care. If you are in crisis or may harm yourself or others, please contact your local emergency services or a qualified professional immediately.

7. Limitation of Liability

To the fullest extent permitted by law, Today's Spark is provided "as is" and "as available" without warranties of any kind. We are not liable for indirect, incidental, special, or consequential damages arising from your use of the app.

8. Account Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms or that create risk to other users or to the service.

9. Governing Law

These Terms are governed by the laws of the State of Hawaii, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of Today's Spark will be resolved in the appropriate courts located in Hawaii unless applicable law requires otherwise.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Continued use of Today's Spark after changes take effect means you accept the updated Terms.
